Plan License Agreement:


GRANT OF LICENSE:

In consideration for payment for these construction documents, MIXSON GRAPHICS LLC dba SOUTHERN HERITAGE HOME DESIGNS grants you, the Licensee, the non-exclusive right to construct a house using these documents. Southern Heritage Home Designs reserves all rights not granted to the Licensee.

Purchase of a Construction Set of plans grants the purchaser a Limited Build License to build one house from the plans.

Purchase of a CAD File Set of plans grants the purchaser an Unlimited Build License to build as many houses from the plans as you like.


COPIES:

One plans set copy is provided and the Licensee may make as many copies of the plans as may be required to complete construction of the house.


LOCAL CONDITIONS:

Plans are designed to comply with the INTERNATIONAL RESIDENTIAL BUILDING CODE. These building codes may or may not be the same as the codes and regulations in the locale where the Customer will construct the plans. Our plans are designed to comply with building codes at the time they were originally drawn. Many states and counties amend the codes for their area. It is the responsibility of the purchaser and/or builder to see that the structure is built to meet the codes of your area. Customer hereby indemnifies and holds Mixson Graphics LLC, its principals, employees and agents, harmless from any claim, loss or liability resulting from the failure of the plans to comply with local building codes or regulations or for any other breach of this Agreement attributable in whole or in part to Customer or its builder.

Because local codes and regulations and even methods of construction vary across the nation and internationally, certain alternative planning may be necessary to adapt the plan to your area. For this reason heating and plumbing are not included with our plans. You should be able to meet with these subcontractors to select and plan the system that is most appropriate for your area. Some municipalities may require plan review by a licensed Architect or Structural Engineer in your area. After plan purchase from Mixson Graphics LLC, the customer is responsible for additional expenses incurred through meeting municipality requirements or other requirements for construction.


STOCK HOUSE PLANS GENERAL NOTES AND DISCLAIMERS:

1. These drawings have been prepared to to conform to the International Residential Building Code in effect at the time the plans were drawn and to meet generally accepted professional standards and practices. These plans have been designed for conditions in the southeastern United States, without knowledge of or reference to the Licensee's specific site or geographical location. Local site conditions, such as frost depth, soil bearing capacity, seismic and wind zones, exposure, etc. may vary. Local code requirements for life-safety requirements may vary. The strength of materials (such as lumber) available locally may vary. Therefore, supplemental to these documents, it is the Licensee's responsibility to consult with their local builder, professional designer, or structural engineer to ensure that these documents meet all current federal, state/provincial and local codes, ordinances/bylaws and regulations, etc., and are appropriate to specific site conditions. Compliance with such requirements shall take precedence over these documents.

2. Any use of this information without adaptation to changes in codes, standards, site conditions and other factors is at the Licensee's sole risk. Southern Heritage Home Designs assumes no responsibility for changes made to these plans by others and makes no warranties, either expressed or implied, in the use of these plans. The Licensee agrees to defend and indemnify Southern Heritage Home Designs for all claims, costs, losses, or damages resulting from the use of these documents.

3. Before beginning construction, it is the Licensee's responsibility to check all dimensions and details, and verify conformance with governing code requirements for the geographic area in which the house is to be built. All structural, mechanical and electrical requirements shall also be reviewed before construction begins. Codes govern over drawings and dimensions govern over scale. Please notify the designer of dimensional discrepancies.

4. Southern Heritage Home Designs has not been engaged for construction supervision of any kind and assumes no responsibility to ensure that the construction conforms to these plans, nor has any responsibility for construction means, methods, techniques, sequences, procedures or safety precautions in connection with the work.

5. The Designer retains ownership of the construction documents, the design, and all subsequent copies of the documents regardless of the form of the original and other copies. This is not a sale of the original documents or the design whatsoever.

6. These drawings and specifications are copyrighted. Unauthorized copying of these documents is expressly forbidden. The Licensee is granted the right to make copies as needed for the construction of one building per plan purchase. Any other copying is unauthorized. The Licensee may be held legally responsible for any copyright infringement that is caused or encouraged by the failure to adhere to the terms of this agreement.
